Data Privacy Policy

Melber Flinn have reviewed the purposes of our storing and processing activities in line with the new General Data Protection Regulations (GDPR) and selected the most appropriate and lawful bases for each activity carried out within the business.

Details on how to manage your data are detailed below under the titles ‘Right to Access’, ‘Right to be Forgotten’ and ‘Complaints’.

If we have spoken to you about registering with Melber Flinn, for the purposes of us sourcing interim opportunities for you, then we will have legitimate interest to record and manage your data, with the intention of finding you opportunities.

If your details are stored by Melber Flinn with legitimate interest, this will be for a maximum time period of 12 months from the date of your registration. If we have no contact with you for a period of 50 weeks, we will contact you by email to check whether you are happy for Melber Flinn to continue holding your data, with the ongoing intention of identifying interim opportunities for you.

It is highly likely Melber Flinn will try to obtain consent to hold your details within this period, if you choose to give consent, please refer to the section below ‘Consent’ for how we will process your details after this point. Without consent to hold your details Melber Flinn will not share your data with any third party.

At any time we will only store details provided by you, on your CV, via email, via telephone or any other electronic means, that we deem necessary to support you in any future job application.

You have the right to access or update any of the details we hold on our systems at any time and the right to be deleted and forgotten. Please see the below sections titled ‘Right to Access’ and ‘Right to be Forgotten’ for further information and instructions on how to make such a request.

Linkedin

If your CV and details are visible on Linkedin Melber Flinn may at any time access these details, should we feel your experience is relevant for any role we are currently recruiting for one of our Clients. Melber Flinn will have legitimate interest to help you find a new job and may choose to download and process your personal data. Melber Flinn will make contact with you within 30 days of downloading your details to make you aware of this.

If your details are stored and processed by Melber Flinn with legitimate interest, this will be for a maximum time period of 12 months from the date of download.
Within 30 days from the date of download Melber Flinn will try to obtain consent to hold your details, if you choose to give consent, please refer to the section below ‘Consent’ for how we will process your details after this point.

Should during the initial period of legitimate interest we deem your experience to be relevant for a subsequent role we are recruiting, and we have not yet received consent from you to store your details, the period of 12 months will begin from the original date of download.

You have the right to access or update any of the details we hold on our systems at any time and the right to be deleted at any time, please see the below sections titled ‘Right to Access’ and ‘Right to be Forgotten’ for further information and instructions on how to make such a request.

Consent

Consent must be provided in writing, including electronic communication, but not including text message.

Upon receiving consent to store / process / share your data with a third party, Melber Flinn will store your data for a period of 36 months from the date the consent was given. This consent request may be renewed at any time. You have the right to access or update any of the details we hold on our systems at any time and the right to be deleted at any time even after giving consent, please see the below sections titled ‘Right to Access’ and ‘Right to be Forgotten’ for further information and instructions on how to make such a request.

The data stored will be used to fulfil your recruitment needs only.

If within the 36 month period Melber Flinn wish to share your data with a third party, separate consent will be requested and full details of where your data is to be sent will be provided to you. It is the responsibility of Melber Flinn to ensure all third parties have their own up to date data protection policies which can be provided to you upon request.

Placement

Should Melber Flinn find you a new role, permanent, temporary, contract or an interim assignment with a Client we will store your details for the duration of the contract being in place with you and said Client. If your contract is directly with Melber Flinn any data will be stored on a lawful basis to comply with your contract.

Right to Access

You have the right at any time to be provided with all of the data that Melber Flinn hold on you. To do this you must contact Melber Flinn with a written request to steve.melber@melberflinn.com The request will be responded to within 30 days and receipt of your request will be confirmed within 5 working days. Should you not receive confirmation of your request within 5 working days please call 07425 605117.

Requests for updates to your stored data should also be sent to steve.melber@melberflinn.com These updates will be carried out within 30 days and confirmation will be sent to you via email once the updates have taken place. If you do not receive confirmation within this time frame, please call 07425 605117 to ensure your request has been received.

There will be no charge for updates or provision of data.

Melber Flinn have the right to refuse any request we deem as unreasonable. Should your request be refused you will be informed within 30 days of these reasons why your request will not be processed. No request will be unreasonably withheld.

Right to be Forgotten

You have the right at any time to request for all data held on you at Melber Flinn to be deleted. To do this you must contact Melber Flinn with a written request to steve.melber@melberflinn.com The request will be carried out within 30 days and receipt of your request will be confirmed within 5 working days. Should you not receive confirmation of your request within 5 working days please call 07425 605117.

Complaints

If you are concerned that Melber Flinn are not handling your data in the correct manner you can make a complaint direct to the ICO, further details of how to do this can be found on their website at https://ico.org.uk/.
